General Conditions

The choice of G Ocean clients and users to use G Ocean's products and services means that you have agreed to comply with the terms, policies and service agreements published on the Website of G Ocean. In addition, when using specific G Ocean services, G Ocean users and clients are subject to separate terms and conditions applicable to each of those services from time to time. 

The invalidity or unenforceability of any provision of these Terms of Use for any reason shall affect only such invalidated provision, and shall not affect the validity of any provision of the remaining terms. If there is a discrepancy between these Terms of Use and another G Ocean service agreements, the most recent shall prevail.

Legal Use

G Ocean reserves the right to suspend the provision of services and products when there are grounds or signs of suspicion that G Ocean users and/or clients have signs of law violation, reports or complaints from Third Parties sent to us reflecting negatively on your activities when using services and products that G Ocean perceives as potentially affecting the safety of G Ocean, the legitimate rights and interests of the community, agencies and organizations. , other individuals.

Then, in order to continue using our services, G Ocean has the right to ask you to provide information to verify and/or make a commitment to be able to continue using the services. In case the incident is found to be of a serious nature, G Ocean has the full right to ask for the intervention of competent Government agencies and specialized functional units to ensure the legitimate rights and interests of G Ocean and/or the community.

Suspension, Termination of Service Provision

G Ocean reserves the right to suspend or completely terminate the provision of services without refunding any costs to clients and users in the following cases:

a) You use G Ocean's products and services for any purpose/form that violates Vietnam law, especially regarding copyright of content, software, songs, etc.

b) You send, link or transit data that is illegal, threatening, deceptive, hateful, misrepresentation, defamatory, obscene, obscene, offensive, etc. or any other form that are prohibited by Vietnam law in any way.

c) You store or transmit any data that constitutes or encourages any form of crime; or data that violates intellectual property laws (patents, trademarks, design rights, copyrights or any other rights...) or infringes on the rights of any individual.

d) You use the website to sabotage another website.

e) You are solely responsible for the content of emails sent from the mailbox in your account.

f) You use programs that have the potential to clog or slow down the system, such as exhausting system resources, overloading the processor and memory.

g) You use your website or account to illegally infiltrate other websites or influence other G Ocean clients or users.

h) When you are attacked by a third party, seriously affecting G Ocean's system. In case of attack, G Ocean will suspend G Ocean user's website in the system, localize the processing and will put its operation back running after fixing the problem.

i) G Ocean users have other violations that the competent Government agencies require to close the website.

k) G Ocean users and/or clients fail to pay fees on time.

l) Users of G Ocean have acts that affect the reputation and brand of G Ocean in the mass media.

m) Other cases prescribed by law.

Third Party Affiliate Services

G Ocean will constantly expand the superiority of products and services, not excluding the association with third-party service providers (e-commerce platforms, shipping units, etc.)

When clients and users use third-party affiliated services integrated in G Ocean products and services, etc., it means that you understand and agree to abide by these general, separate terms and conditions applied to each service. 

When using the linked services with a Third Party, you understand and agree to the linked services terms of use and agree to share the information and data necessary to use the linked services. G Ocean only shares information and data that you have agreed to share and are necessary for the Third Party to be able to provide the requested services. G Ocean users and clients are encouraged to refer to the terms of use of the services with Third Parties regarding the information and data shared when using the linked services.

Resolving Problems

You are responsible for immediately informing G Ocean when detecting a problem, actively coordinating with G Ocean so that we can fix the problem for you as soon as possible. In the event of an incident involving a Third Party, it is your responsibility to coordinate with the Parties involved to resolve it. The clients understand and accept that, in all cases, G Ocean always tries to support and remedy, however, G Ocean will not be responsible for damages arising from delay, failure to notify or conceal information about your problem(s).

Limitation of Liability

After handing over the service administration parameters to the user, G Ocean is not responsible and does not guarantee the accuracy of your information on the products, solutions and services you provide. At the same time, G Ocean is not liable and indemnifies you and the Third Party for direct, indirect, unintentional, intangible damages, loss of profits, revenue, reputation developed arising from using G Ocean's products and services after G Ocean has handed them over to you.

G Ocean will certainly not bear any responsibility or liability for the consequences of unauthorized access to G Ocean's servers; clients and users equipment and/or personal data due to accidents, illegal acts, Third Party equipment and other causes beyond G Ocean's control.

As a condition of using products and services at G Ocean, you now agree that G Ocean, its employees, member organizations, shareholders, agents, and suppliers will not be liable for any of your Third Party's loss of profits, business opportunities or damages, costs incurred directly or indirectly in connection with G Ocean or other G Ocean services.

G Ocean recommends that clients and users should learn about Third Party partners carefully before promoting cooperation to avoid unexpected damages. G Ocean neither warrants nor is responsible for any products or services from your Third Party when using G Ocean's products and services.

G Ocean sẽ không chịu trách nhiệm đối với trường hợp Khách hàng cố tình vi phạm chính sách sử dụng của Facebook, Google… hay bất cứ Bên thứ ba nào gây hại trực tiếp, gián tiếp, vô ý, vô hình, các thiệt hại về lợi nhuận, doanh thu, uy tín phát sinh từ việc sử dụng sản phẩm khi đã được hỗ trợ thông báo, hướng dẫn sử dụng trước từ phía G Ocean.

Guaranteed Service Delivery

G Ocean cung cấp các sản phẩm và các tính năng đi kèm trên cơ sở “có thể thực hiện được”. G Ocean sẽ không bảo đảm rằng sản phẩm của chúng tôi sẽ luôn luôn sẵn sàng, luôn có thể sử dụng, không bao giờ bị gián đoạn, đúng thời gian, không có lỗi bởi các sự cố như: Hacker, mất mạng Internet trên diện rộng… Tuy nhiên, G Ocean và các nhân viên của G Ocean sẽ cam kết cố gắng trong mọi điều kiện và làm hết sức khả năng có thể để đảm bảo rằng sản phẩm và dịch vụ của chúng tôi luôn được sẵn sàng cho việc sử dụng. G Ocean cam kết nỗ lực khắc phục sự gián đoạn và đưa ra sự điều chỉnh, sửa chữa và hỗ trợ trong khả năng có thể để phục hồi hệ thống, dịch vụ một cách nhanh chóng.

Resolve Inquiries, Complaints, Disputes

Depending on the complexity of the complaint(s), G Ocean will have a corresponding processing time. Complaint settlement results will be notified to clients and users, in case of necessity, G Ocean can invite complainants to work directly. G Ocean will make every effort to always resolve the complaints of clients and users as soon as possible and in the spirit of negotiation, reconciliation, respect, and mutual benefits.

b) Trong quá trình sử dụng nếu xảy ra tranh chấp giữa người sử dụng và G Ocean, hai bên sẽ tiến hành đàm phán hòa giải với tinh thần hữu nghị. Trong trường hợp không giải quyết được bằng hòa giải sẽ đưa ra Toà án nhân dân TP. HCM giải quyết.
